Hereinafter, the company will be referred to as “SIARK NEON”, “the Seller” or “the Company”.

2. Definitions

Website – the online platform www.siarkneon.com.

Client – any natural or legal person who uses the website and/or places an order.

Order – a request submitted by the Client to purchase one or more products.

Customised Product – any product made according to the Client’s specifications, including text, design, logo, dimensions, colours, shape, graphics or other elements requested or approved by the Client.

Standard Product – a product available in the SIARK NEON collection that is not made or modified according to the Client’s individual requirements.

Distance Contract – a contract concluded between the Client and the Seller via the website or by means of distance communication.

3. Products and Services

SIARK NEON manufactures and sells customised illuminated signs, decorative lighting products, branding elements and other similar products.

Images, renderings and simulations displayed on the website are for informational purposes. Minor differences in colour, light intensity or appearance may occur depending on screen settings, the materials used and specific features of the production process.

SIARK NEON reserves the right to update product specifications without affecting orders that have already been confirmed.

4. Customised Products

Most SIARK NEON products are made to order according to the Client’s requirements.

Before production, the Client may receive a simulation or mock-up for review and approval for certain projects.

By approving the final design, the Client confirms that they have reviewed and accepted:

• the text;
• the dimensions;
• the colours;
• the shape of the product;
• the graphics;
• the positioning of the elements;
• the other specifications provided.

The Client is responsible for carefully reviewing the design before approval.

SIARK NEON cannot be held responsible for errors in text, proportions, colours or other elements that were presented to and approved by the Client before production began, except where the final product does not match the approved design.

5. Placing and Confirming Orders

Orders may be placed through:

• the website;
• the online configurator;
• the custom design form;
• e-mail;
• other communication channels made available by SIARK NEON.

Submitting a request or completing a form does not automatically constitute acceptance of the order.

An order is considered confirmed once it has been accepted by SIARK NEON and, where applicable, after the design has been approved and payment has been confirmed.

SIARK NEON reserves the right to refuse or cancel an order in situations such as:

• incomplete or incorrect information;
• technical inability to produce the design;
• reasonable suspicions of fraud;
• inability to process the payment;
• other justified circumstances that prevent the order from being fulfilled.

If an order that has already been paid for is cancelled before production begins, any amounts owed to the Client will be refunded based on the specific circumstances and applicable law.

6. Prices

Prices displayed on the website are stated in Romanian lei (RON), unless otherwise indicated.

For configurable products, the price may vary depending on:

• size;
• the length and complexity of the design;
• the type of backing;
• colours;
• indoor or outdoor use;
• additional options;
• other project-specific features.

For projects based on a logo, drawing, sketch or graphic, the final price may be set in a customised quote.

SIARK NEON may change the prices displayed on the website, but such changes will not affect orders that have already been confirmed.

7. Payment Methods

Payment may be made using the methods available on the website at the time the order is placed, including:

• online bank card;
• bank transfer;
• other payment methods displayed during checkout.

For certain customised products, production may begin only after payment or the agreed project deposit has been confirmed.

8. Design Approval

For projects requiring a simulation or mock-up, production begins once the Client has approved the final design.

Once production has begun, it may no longer be possible to modify the design, or doing so may incur additional costs.

If the Client requests a change after approving the design, SIARK NEON will confirm whether the change can still be made and whether it will affect the price or production time.

9. Production Time

The standard production time is generally approximately 3–5 business days.

During busy periods, this may extend to approximately 7–10 business days.

The timeframe may vary depending on:

• the complexity of the project;
• the size of the product;
• the availability of materials;
• the volume of orders;
• changes requested by the Client.

If the product is needed by a specific date or for an event, we recommend that the Client let us know before confirming the order.

10. Delivery

Orders are packaged and prepared for transport according to the size and characteristics of the product.

Once production is complete, orders are handed over to the courier company.

Delivery times are estimates and may be affected by factors beyond SIARK NEON’s control, such as:

• the courier company’s operations;
• busy periods;
• weather conditions;
• public holidays;
• transport restrictions;
• force majeure events.

SIARK NEON delivers in Romania and, subject to the availability of transport services, to other European countries.

The delivery cost is displayed or communicated to the Client before the order is finally confirmed.

11. Checking the Parcel

Clients are encouraged to inspect the product and packaging immediately upon receiving the parcel.

If the product appears to have been damaged during transport, the Client should contact SIARK NEON as soon as possible.

To resolve such issues promptly, we recommend submitting a notification within 48 hours of delivery.

Where possible, the request should include:

• photos of the product;
• photos of the damaged area;
• photos of the packaging;
• photos of the shipping label;
• the order number;
• a brief description of the problem.

After reviewing the situation, SIARK NEON will communicate the available solution, which may include repairing, replacing or remaking the product, or another solution appropriate to the circumstances.

12. Returns of Standard Products

Standard, non-customised products may be returned under the terms and within the time limits provided by applicable law.

Consumers may exercise their right of withdrawal, as provided by law, within 14 calendar days of receiving the product.

The returned product must be kept and handled appropriately.

The Client may be liable for any reduction in the product’s value resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

13. Customised Products and the Right of Withdrawal

Products made to the Client’s specifications or clearly customised are exempt from the right of withdrawal, subject to the provisions of applicable law.

Accordingly, illuminated signs made to order based on the Client’s text, design, logo, dimensions, colours or other individual requirements cannot be returned because the Client has changed their mind.

This rule does not limit the Client’s rights if a product is non-conforming, defective or does not match the approved design.

14. Warranty

SIARK NEON illuminated signs are covered by the 2-year statutory conformity warranty, subject to applicable law and proper use of the product.

The warranty may cover manufacturing defects and issues with electrical components that are not caused by improper use.

To the extent permitted by law, the warranty does not cover:

• mechanical damage;
• impact, shocks or breakage;
• improper use;
• contact with water or moisture for products intended exclusively for indoor use;
• incorrect installation;
• interventions or modifications carried out by unauthorised persons;
• damage caused during subsequent transport or handling by the Client;
• normal wear and tear.

To assess a warranty claim, SIARK NEON may request photos, video footage or other relevant information.

Depending on the circumstances and applicable legal provisions, the solution may consist of repair, replacement, bringing the product into conformity or another measure provided for by law.

15. Use of Products

The Client must use the product for its intended purpose and in accordance with the instructions provided.

Products intended exclusively for indoor use must not be permanently exposed to rain, water, excessive moisture or other conditions for which they were not designed.

A version intended for outdoor use must be ordered for permanent outdoor use.

The product must be disconnected from the power supply before cleaning or working on it.

16. Intellectual Property Rights

The texts, images, photographs, graphics, visual elements, logos, video materials and other elements of the website belong to SIARK NEON or are used under the appropriate rights or licences.

Copying, reproducing, distributing, modifying or using these materials without the prior consent of the rights holder is prohibited, except where permitted by law.

A Client who provides SIARK NEON with a logo, drawing, image, graphic or other material for making a product declares that they have the right to use that material for the requested purpose.

The Client is responsible for the materials and graphic elements they provide.

17. Personal Data Protection

SIARK NEON processes personal data in accordance with applicable law, including Regulation (EU) 2016/679 – GDPR.

Data may be used for:

• processing orders;
• issuing fiscal documents;
• communicating with the Client;
• making and delivering products;
• handling return or warranty requests;
• fulfilling legal obligations.

18. Limitation of Liability

SIARK NEON cannot be held responsible for circumstances beyond its reasonable control, such as:

• temporary website outages;
• technical errors originating from external services;
• courier delays;
• incorrect information provided by the Client;
• use of the product contrary to its intended purpose;
• force majeure events.

Nothing in these Terms and Conditions limits the rights to which consumers are mandatorily entitled under applicable law.

19. Force Majeure

Neither party shall be liable for failure to perform or delay in performing its obligations where this is caused by a force majeure event, as provided by applicable law.

20. Complaints and Dispute Resolution

If there is a problem with an order or product, the Client is encouraged to contact SIARK NEON first to identify an amicable solution.
